Preamble

The following dispositions define the Terms of Sales of the products and services sold by the company Bastille, on its web site www.bastille-bijoux.com (or www.bastille-bijoux.fr). 

Bastille is an EURL, which capital is 5000€, and which is based in 6, Avenue Neil Armstrong – 33692 MERIGNAC CEDEX. Bastille is registered in the Bordeaux Register of Companies under the number 843 518 390. 

Bastille reserves the right to adapt or modify the following Terms of Sales, at any time. The applicable version is the one on-line when the purchase occurs. As a consequence, any purchase on the web site should be preceded by a full and unconditional acceptation of the Terms of Sales: the box before the mention “I read and fully accept without any reserve the Terms of Sales” should be ticked before the payment. Without this validation, the purchase will not be finalized. 

The site is a commercial web site, accessible to any Internet user, 7 days a week, 24h a day. Nevertheless, some interruptions might occur, rather they are planned or not; they can impact the Site accessibility either for maintenance or because of force majeure. Bastille cannot be held responsible for any direct or indirect damage, whatever its nature or cause could be, resulting from the Site unavailability. Moreover, Bastille cannot be held responsible in case of connection difficulty or network unavailability. 

The Site is in French or in English languages. Foreigners clients purchase their order being informed on that point, and cannot argue linguistic misunderstanding in any way. 

  1. Contract object:

These Terms of Sales define the order, payment, delivery, exchange and potential return processes for the purchasers who buy Bastille products and services on its Website; as well as the rules running the relationship between Bastille and its clients. 

  1. Products: 

The products sold on the website are precisely described in a product page, trying to define as precisely as possible their characteristics: picture, material, color, dimensions and price especially. Bastille takes great care of these product pages, it is nevertheless possible that an error occurs, which is recognized and accepted by the Client. 

Bastille draw also the Clients’ attention on the fact the color setting of our camera, or of your devices (computers, phones or digital tablets) might alter the color perception versus its real color. As a result, products colors cannot be guarantee.  

Lastly, Products stocks are updated in real time. I might be possible that an error in the update happens. In such a case, Bastille cannot be held responsible of an Order cancellation in case of shortage, whatever the cause is. 

  1. Price: 

Prices are expressed in euros, all taxes included. 

Bastille can modify its prices any time. Nevertheless, the price of a product cannot be changed once the order is validated. Price does not take into account potential delivery fees, that will be defined and added to the Client order before its final validation. 

Products delivery is not limited territorially. In case of an order out of France, the Client is the only responsible for potential custom duties or any other expense due to the importation of one of our Product.

Products remain Bastille’s full property till the purchase is not finalized. 

      4 – Order

The Order results from different steps during which the Client can assess and modify its choices at any time: 

The Order will be fulfilled once the Client accept the Terms of Sales without any conditions by ticking the box “ I red and fully accept the Terms of Sales”. Then, he will access the payment page. Bastille will send an Order confirmation e-mail, summing up the Order details (Products, quantities, color, price, delivery mode…)

Very exceptionally, Bastille can modify or withdraw a Product from the Site, and refuse to proceed afterwards to an Order of this Product, which would have been done just before the modification. In such a situation, the Client would be of course reimbursed and Bastille could not be held responsible towards the Client or any other person of a potential damage due to the withdraw or the modification of this product. 

  1. Payment and transaction security:

The Order payment can be done with credit card (Visa, Eurocard/Mastercard…), through the safe payment platform of our partner Pay Plug. The Client expressively recognizes that the communication of its banking information means the payment authorization. In case of payment refusal, the Client will be told by Bastille via e-mail. 

Bastille can refuse or cancel a payment for a legitimate reason, especially in case of litigation with the Client regarding a previous Order, or in case of bank refusal. In any case, Bastille should explain to the Client its refusal motivation. 

Products remain Bastille’s property till the payment is not finalized. 

When the payment is finalized, the Client receives confirmation e-mail. 

  1. Delivery

The delivery is done to the delivery address given by the Client. This address must be its residential address. No delivery could be done in hotels, or postal boxes. In case of no delivery because of a wrong address, no re-delivery could be done and the Client would be reimbursed (except the delivery fees). 

Bastille declines any responsibility in case of loss or theft. 

Order preparation timing is from 2 to 5 working days. 

Delivery timing is from 2 to 5 days. 

In the 10 following day after a new collection is released, or between November 25th and December 31th, delivery timing could increase up to 10 working days, due to exceptional Orders volume. 

7 – exchange and retraction right: 

Accordingly to the L221-18 article from the Consumption Code, the Client has a fourteen (14) days deadline from the Order reception to return or exchange it; with few conditions: the Product must be in perfect conditions, must not have been worn, and must be in its original pouch, also in perfect condition. If one of those conditions was not respected, the reimbursement or the exchange could not be done. After this fourteen (14) days deadline, the Sale is considered as confirmed and finalized. Our products are hand-made, we are highly taking care of each jewel we produce. If despite those efforts a default was detected at reception, we would exchange or accept the product return at our own expenses. If it is the Client decision to return or to exchange a Product in good condition, he will have to pay the delivery fees.

  1. Legal conformity guarantee: 

All Bastille Products are benefitting from a legal conformity guarantee (article L217.4 and following of the Consumption Code), and the guarantee against hidden defect (article 1641 and following of the Civil Code) allows the Client to send back to Bastille any Products delivered with defects or non- conformity. 

9 – force majeure:

In case of force majeure (exceptional, unpredictable and insurmountable circumstances, independent of Bastille’s will), Bastille should inform its client of its incapacity to honor this Terms of Sales within a fifteen (15) working days deadline starting the day the event is discovered. All Bastille and its Clients obligations will be suspended during the event. If the force majeure should last longer than one (1) month, the Order could be cancelled, because of Bastille or its Client, without any indemnity. Some force majeure non exhaustive examples: natural disaster (storm, fire, flood, snow storm, earthquake…) strikes, terrorism, riots, wars, epidemics… or any other exceptional, unpredictable and insurmountable circumstances, independent of Bastille’s will that will stop the good execution of these Terms of Sales. 

10- Intellectual property: 

Any reproduction, usage, or apposition of the Bastille brand is forbidden, except if Bastille expressly accepts it, accordingly to the article L713-2 of the Intellectual Property Code. 

It is also reminded that Bastille creations (drawings, sketches, jewels, etc.) and all their representations (objects, visuals, pictures, drawings, designs, logo, packaging, collection names, Products names, illustrations, etc.) are the exclusive Bastille’s property, et benefit from Author Right protection as Bastille Intellectual Property. Any use without prior authorization will be prosecuted. 

11 – personal data: 

The protection of your private life and your personal data is key to us. 

Actually, in order to make sure that its website, www.bastille-bijoux.com or www.bastille-bijoux.fr , works properly, the Bastille brand needs to collect some of your personal data. These personal data will be treated in the respect of the law n°78-17 of January 6th of 1978, related to data processing, files and freedom in its modified version, as well as in the respect of other French or European relevant texts, especially the RGDP (European Law n°2016/679/UE of April 27th of 2016).

What are the data we are collecting?

When you register or create an account on our website, or when you make an order, Bastille collects the following Data:

Moreover Bastille may collect, during the use of its website, connection data (date, consulted pages…) for statistic purpose. 

When a product is ordered on its website, Bastille financial partners collect payment data (card number, validity date, ..) Payment processes are secured. Those banking data are not used by Bastille, nor by its partners.

Why do we collect those data? 

Most of the data you communicate to Bastille are necessary to prepare and deliver your order, but also to enable commercial relationship:

The collect of your data also allows us to propose to you products depending on what you like, and to organize some prospection operations. 

How are treated your data and who has access to it? 

Your personal data are hosted in European Union.

The collected data will be only used by Bastille.

Nevertheless, Bastille can ask sub-contractors or partners to use some of those data punctually, and temporarily: marketing agencies, consumer relationship management agencies…Guarantees have been taken to make sure that the data will be secured. Your data could be given as well to authorities if asked. In any case, your data will never be given to a third party, nor sold or exchanged without your express approval. 

What is the duration of the retention of your data?

Your personal data will be kept accordingly to the law, meaning 3 years for prospection and 10 years for our legal obligations. 

How can you contact us to exercise your rights?

Accordingly to European Rules on data protection, you can access, modify, delete, limit the use of your personal data. You can also define post-mortem instructions. A copy of your identity card could be asked. You can also send any claim to the CNIL (www.cnil.fr).
